Would my brother, who is about to go to basic, be in trouble for having a 16 year old girlfriend?

My younger brother who is 19, has joined the Army and will go into Basic training next month. His girlfriend, who he's known since childhood, is 16. She lives in a different state for the moment, but if they were to take their relationship to a sexual level, would he get in trouble? Would he be court martial ed?
